Under Code of Federal Regulations (CFR) § 396.3(a), every motor carrier and intermodal equipment provider must systematically inspect, repair, and maintain all motor vehicles and intermodal equipment subject to its control. CFR § 393.209(e) provides that all components of a power steering system must be in operating condition with no parts loose or broken, belts that are not frayed, cracked, or slipping, and a system that does not leak and has sufficient fluid in the reservoir.
CFR §396.3(a)(1) establishes that all parts and accessories must be in safe and proper operating condition at all times, including steering systems and any additional parts and accessories that might affect steering systems. Under CFR §396.11, every motor carrier must require drivers to report and every driver must prepare a report in writing at the completion of each day’s work on each vehicle operated. The report must cover the steering mechanism as well as the service brakes including trailer brake connections, parking brake, lighting devices and reflectors, tires, horn, windshield wipers, rear vision mirrors, coupling devices, wheels and rims, and emergency equipment.

The pitman arm on the steering gear output shaft cannot be loose, and steering wheels must turn freely through the limit of travel in both directions. Universal joints and ball-and-socket joints wear over time and it is not surprising when a tractor-trailer with significant miles in which a driver claims steering failure also has a ball joint with a corroded surface.
