Causes of Roll-Over Truck Accidents

A 2008 study entitled “Analysis of large truck rollover crashes” published in the Association for the Advancement of Automotive Medicine Annual Scientific Conference analyzed 239 rollover crashes identified in the FMCSA 2002 Large Truck Crash Causation Study. According to the study, almost half of the crashes were caused by a failure to adjust speed to curves in the road (largely on-and off-ramps), the load being carried, condition of the brakes, road surface, and intersection conditions.

Speeding and failure to adjust speeds was the most common cause, but the second major contributor was identified as inattention. This could be the result of distracted driving, although federal law prohibits truck drivers from using cell phones while they are operating commercial motor vehicles. The study also said some drivers were simply inattentive or may have dozed off or even fallen asleep.

Steering issues such as oversteering, not steering enough to stay in lane, and overcorrecting were identified as the third rollover crash contributor. The final contributor was loads, such as situations in which drivers fail to take account of their weight, height or security, or when loading takes place before they are assigned.

Other causes of roll-over truck accidents might include, but are not limited to:

  • Driving under the influence (DUI) of drugs or alcohol
  • Aggressive driving
  • Inadequate driver training
  • Brake failure
  • Failure to maintain vehicle
  • Reckless driving
  • Inclement weather
  • Mechanical defects

Many of the causes listed above are forms of driver negligence. A truck driver rarely has the personal wealth or assets necessary to cover the size of judgments that may be awarded in rollover crash cases, but a trucking company and many other parties could also be liable in some cases.

Types of Roll-Over Truck Accident Injuries

A roll-over crash can be incredibly frightening for the occupants of many other motor vehicles involved in the accidents. A truck that rolls over can simply crush vehicles it falls on to, and the people inside are usually powerless to escape in time or lessen the severity of the impact.

Many people will die from the injuries they suffer in roll-over accidents. The family members of a deceased person can then file a wrongful death lawsuit to recover damages for the costs they incur following a loved one’s death.

People who survive their injuries can still face a very difficult road to recovery. Some injuries will require extensive medical treatment, such as:

  • Lacerations
  • Paralysis
  • Traumatic brain injuries (TBIs)
  • Fractures
  • Muscle strains
  • Internal organ injuries
  • Spinal cord injuries
  • Neck injuries
  • Sprains

The insurance companies for truck drivers and trucking companies will aggressively seek to minimize their losses in these cases. They may offer you a lump sum settlement to resolve your case, but you should know that you are usually entitled to far more than whatever you are being offered.
